Virtually all alleged crimes which occur on the Commonwealth's roadways are recorded by state and local law enforcement audio and video recordings, called Mobile Vehicle Recordings ("MVRs"). While these law enforcement agencies have in-house custodians of these electronic records, the degree of knowledge and training of these individuals is unknown, and we have received, on multiple occasions just within the past few months, MVRs which are corrupted, incomplete, and we have been informed that the relevant law enforcement agency does not know how to fix the problem with these sometimes essential pieces of evidence. Though I have been personally able to recover some data from these videos - using amateur moving-making software - other problems that we have encountered are far, far beyond the competence of anyone in this office pertaining to the very time-consuming task of data recovery of incomplete or damaged electronic evidence. Create a digital archive of all client files in accordance with our internal file retention policies. This final point is the most essential one. This law office has retained client files dating back to the 1950s, on everything from a series of eminent domain cases this law firm handled back during the major public works building period of the 1950s and 60s, as well as medical malpractice, and other personal injury cases, etc. The files on single clients in many of these instances are hundreds of pages, and sometimes in the thousands, and approximately half of our law library - which is significantly larger than the size of an average small firm law library - has been re-appropriated to house these client files. Simply stated, we are running out of space, were in the process of considering a hiring a specialist to come in and perform said archival services, until we became aware that a student, such as Mr. Stuart, could provide these services for us and receive credit towards his degree. |
